Global American Terms and Conditions
Your order with Global American Inc. (GAI) is automatic acceptance of the following:
Payment
- All orders are prepaid unless approved for NET terms. For consideration of NET terms, please submit completed and signed credit application.
- Due to the customized nature of our products, prepaid orders are charged 100% at time of order.
- For customers paying with credit card, shipping is charged separately on day of shipping.
- Global charges a 2.5% service fee for credit card transactions. We accept MasterCard, Visa, American Express and Discover.
- For International Customers, we accept payment via Wire Transfer only. The customer is responsible for all charges associated with said transaction.
- All payments are to be made in USD, and all refunds are paid in USD without consideration of conversion rates at time of transaction.
- For customers on NET terms, any prepayments or deposits will be applied to the final invoice(s)/shipment(s), unless otherwise agreed upon in writing.
- Overdue invoices are subject to 1.5% finance charge per month and can result in credit hold and/or terms revocation.
- Invoice due dates are calculated based upon date shipped/invoiced, not delivery date.
- Mailed check payments are not accepted. We accept ACH, Wire Transfer, or Credit Card. For electronic payment, please complete form.
- Global does not accept any short payments or deductions for any reason (RMA, damage, etc.). Failure to comply may result in credit hold, terms revocation and a 1.5% monthly finance charge.
Shipping
- Delivery dates are not guaranteed and are at the mercy of the carrier.
- The customer is responsible for all shipping, customs, and duty charges.
- For customers without NET terms, we ship UPS prepaid and add.
- All shipments are FOB Hudson, NH.
- Global insures all shipments. To waive insurance, a declaration of insurance waiver must be provided.
- If there is evidence of damage in transit, do not remove product from packaging and contact us immediately.
- If a delivery is refused, the customer is responsible for all shipping costs back to Global and any applicable restocking charges.
Warranty
- Global warranties that its products will, at the time of shipment, be free from defects in material and workmanship and will conform to applicable specifications as agreed upon in writing prior to shipment.
- Warranty extends to and may be invoked by the customer only and does not extend to a third party.
- In no event shall Global be liable for any incidental or consequential damages due to breach of this warranty or any other obligation under this order or contract.
- This warranty shall not apply to any products Global determines to have been subjected to testing for other than the specified electrical characteristics or to operating and/or environmental conditions in excess of the maximum values established in our specifications. Neither shall this warranty apply to products that have been the subject of mishandling, misuse, static discharge, neglect, improper testing, unauthorized repair, alteration, damage, assembly, or processing that alters physical or electrical properties.
- Flashing of the BIOS without prior written authorization to do so from Global will result in a voided warranty.
- All products carry a 12-month parts and labor warranty for repair and a 7- day replacement warranty from the date of shipment, unless otherwise specified.
- Under special circumstances and with prior notice, some products may be excluded from our warranty.
- Waiving of our standard stress, test and burn-in procedure is done at customer’s risk and liability and voids any warranty.
- Global will make every effort to repair out of warranty product for a fee, however, is under no obligation to accept RMAs for out of warranty product.
- Global reserves the right to repair or replace items. Certain product may be cross shipped at Global’s sole discretion and at the customer’s expense.
Returns
- Global must be notified within 15 days of ship date if product does not meet customer provided specifications, otherwise a charge will be incurred at a rate of $180/hour for any bench time spent in rectification.
- Dead on Arrival (DOA) product must be returned within 15 days from ship date.
- Custom products, custom configurations and ALL software are not returnable or refundable.
- Product may be returned within 7 days for refund and 30 days for credit and are both subject to a 30% restocking fee. Items must arrive in original condition with all accessories and in original packaging and condition
- All shipping charges incurred by the customer for the original shipment are non-refundable.
- Returns are not accepted unless accompanied by an RMA number. The shipment will be rejected if the RMA number is not present on carton.
- RMA numbers are valid for 10 days.
- All incoming returns will be examined for Global’s barcode. This barcode must be on the materials for your RMA to be valid. A missing barcode invalidates the RMA and voids all warranty.
- We reserve the right to repair product using equivalent or enhanced components.
- Warranty is in effect from original shipment date, regardless of the repairs or replacement made during the term of the warranty.
- Product in warranty with No Problem Found is subject to a $180.00 flat fee.
- Product within warranty period found to have error/failure caused by the customer is subject to a $180.00 flat fee and voids warranty.
- Out of warranty product is subject to an initial $180.00 technician evaluation fee. Repair charges will be quoted separately.
- Failure Analysis can be performed for a fee of $500. This one-time charge does not include repair.
- Unpaid product or product held in inventory with no action for more than 60 days could be scrapped at the customer’s expense.
Website
- Products on our website may be revised or discontinued at any time. Specifications on the informational pages contained within Global’s website are subject to change without notice.
Quotations and RFQ
- Price quotations are valid for 7 days unless otherwise stated.
- The delivery committed on quotations are based upon the inventory situation and our vendor commitments at that time and may vary from the ship date confirmed after the PO is received.
Purchase Orders
- Orders accepted by Global may be canceled only upon written consent, within 24 hours of order placement, otherwise a restocking charge of 30% of the total item cost will apply.
- Special orders for product not normally stocked are non-cancelable and non-returnable.
- All POs referencing a customer part number must be accompanied with a copy of that specification, or the PO must indicate that the part number is “for reference only” or “not applicable to vendor”.
Life Support Policy
- Global products are not authorized for use as critical components in life support devices as described herein:
- Life support devices or systems are devices or systems which, (a) are intended for surgical implant into the body, or (b) support or sustain life, and whose failure to perform, when properly used in accordance with instructions for use provided in the labeling, can be reasonably expected to result in a significant injury to the user.
- A critical component is any component of a life support device or system whose failure to perform can be reasonably expected to cause the failure of the life support device or system, or to affect its safety or effectiveness.
Modifications to these Terms & Conditions
- These terms and conditions represent terms of sales between the customer and Global and may not be altered, supplemented, amended, or otherwise modified without the express written consent of an authorized representative of Global.
- Acceptance of our Terms & Conditions constitutes acceptance of our Privacy Policy. Global will only make contact regarding your purchase and via our company newsletter. You may opt-out of these newsletters at any time.
